This policy covers Biddly Enterprises Pty Ltd and its related bodies corporate (“Biddly”, “we” or “us”).
We understand how important it is to protect your personal information. This policy is our commitment in respect of personal information we hold about you and what we do with that information. Our commitment is to abide by the Australian Privacy Principles for the protection of personal information, as set out in the Privacy Act 1988 (Cth).
1. Collection of personal information
When we refer to personal information, we mean information about you from which your identity is reasonably identifiable. This may include information or an opinion about you whether true or not.
The kinds of personal information we may collect about you include:

Contact details including telephone number and email address;

if you are an Biddly client, we will disclose your personal information to your chosen car dealership;
if you are applying for a vehicle loan, we will disclose your personal information to the applicable financier;
if you are applying for or have an insurance policy, we will disclose your personal information to the applicable insurer; or
to our personnel, agents, contractors and service providers that are involved in providing, managing or administering the applicable products or services (eg printing and postal services and call centres);
to those companies who provide information and infrastructure systems to us;
to anyone acting on your behalf;
to our professional advisors and consultants, accountants, lawyers and auditors;
to anyone else in relation to whom you have provided us consent;
to any company within Biddly Enterprises;
if you are applying to work for Biddly Enterprises, your referees, the Australian Federal Police (to undertake criminal history checks), educational and professional obligations (to verify academic qualifications, licences and memberships), to organisations that conduct competence and psychometric tests, and the Department of Immigration and Citizenship (to verify your right to work in Australia);
where we are required to do so by law.
Prior to disclosing any of your personal information to another person or organisation, we will take all reasonable steps to satisfy ourselves that:
(a) the person or organisation has a commitment to protecting your personal information at least equal to our commitment, or
(b) if required, that you have consented to us doing so.
One of the ways we store and manage information (including personal information) is by using cloud computing, where servers are based overseas. We take reasonable steps to maintain the security of your information and to ensure your information is treated in accordance with the standards that apply in Australia.
4. Direct marketing
For some customers we may from time to time use your personal information to provide you with current information about loans, insurance products, special offers you may find of interest, changes to our organisation, or new products or services being offered by us or any company we are associated with.
If you do not wish to receive marketing information, you may at any time decline to receive such information by contacting us. Contact details are set out at section 10 of this policy.
If the direct marketing is by email you may also use the unsubscribe function. We will not charge you for giving effect to your request and will take all reasonable steps to meet your request at the earliest possible opportunity.
5. Accessing, updating and correcting your personal information
You can request to access your personal information we hold at any time.
An initial response will be provided to you within 7 days from your request, and the outcome of the investigation given in 30 days. There may be situations where we are not required to provide you with access to your personal information, and we will set out the reasons for this. An example of this would be where the information related to existing or anticipated legal proceedings, or if your request was vexatious.
You may also request to correct any of your personal information we hold if it is incorrect, inaccurate or out of date. We will generally rely on you to assist us in informing us if the information we hold about you is inaccurate or incomplete.
Depending on the request we may update your personal information immediately, or we may provide an initial response to you within seven days of receiving your request. Where reasonable, and after our investigation, we will provide you with details about whether we have corrected the personal or credit information within 30 days from your initial request.
We may have to consult with external entities as part of your request to access or correct your personal information.
6. Using government related identifiers
If we collect government related identifiers, such as your Drivers Licence Number we do not use or disclose this information other than to the extent required by law. For instance, we will never adopt your Tax File Number as your account number to identify you.
7. Doing business without identifying you
In most circumstances it will be necessary for us to identify you in order to successfully do business with you. However, where it is lawful and practicable to do so, we will offer you the opportunity of doing business with us without you providing us with personal information.
When we are requested to obtain quotes from dealers & financiers/brokers for you, we do not release any information that would identify you. Once you select a quote from a dealer, we will then provide your contact details to that dealer, lender or finance broker so they may get in touch with you.
8. How safe and secure is your personal information that we hold?
We will take reasonable steps to protect your personal information by storing it in a secure environment, and when the information is no longer needed for any purpose for which the information may be used or disclosed, it will be destroyed or permanently de-identified. We store your personal information in paper and electronic form. We will also take reasonable steps to protect any personal information from misuse, loss and unauthorised access, modification or disclosure. We do this by:
installing security and access requirements for all our IT systems, such as passwords, firewalls and virus scanning software;
having document storage and destruction policies;
only providing you your personal information where we are satisfied as to your identity; and
encrypting data and other personal information during internet transactions (if any).
If you are dissatisfied with how we have dealt with your personal information, or have a complaint about our compliance with the Privacy Act, you may contact us using the details in clause 10.
We will acknowledge your complaint within seven days and provide you with a decision on your complaint within 30 days.

To be clear upfront we are neither a dealership, vehicle broker not a financial services provider. We provide this website (Website) to facilitate requests for price quotation on vehicles from vehicle dealers and loan quotations from qualified finance brokers (Service).
By using the Website, you acknowledge and agree to these conditions of use (Conditions of Use). If you do not agree to be bound by and comply with these Conditions of Use you may not access or use our current information, services, or website.

Use of Your Information
In order to purchase the Service, submit comments, review your Dashboard/quotes and access some features of the Website, you will need to be a registered user. When registering to become a registered user and activate an account, you must provide personal information such as your name and address, and a valid email address. You agree to provide accurate and complete information and to keep this information current.
You are solely responsible for the activity that occurs on your account, and you must keep your account password secure.
You may not use another user’s account without permission.
If you suspect or become aware of any unauthorised use of your account or that your password is no longer secure, you agree to notify us immediately.
Request for vehicle quotes
Quotes, advertisements or products displayed on the Website do not constitute an offer to sell.
A request for vehicle quotes placed by you represents an authorisation from you to communicate with vehicle dealers in regards to the supply of the vehicle specified by you or a substantially similar vehicle subject to the terms and conditions of that dealer.
Once a request for vehicle quote is placed by you, you may subsequently cancel that request. However, any fees that have been or may become payable by you for the Service will remain payable, or if they have been paid will be non-refundable to you.
We may accept or reject your request for vehicle quote at our discretion, this is normally due to the unavailability of that particular vehicle. If we reject your order, we will provide a full refund of any payment received.
The fee for the Service is in Australian dollars and includes GST.
Quotes from dealers
Where you have submitted a request for a vehicle quote and are presented with the products and prices, the:
Prices of products are current at time of display but are subject to change;
Prices are shown in Australian dollars and include GST, other taxes and charges and on-road costs if applicable;
The price displayed for the product may not include the addition of options or accessories that can be added to the vehicle at your expense.
Quotes from brokers/financiers
Where you have submitted a request for a finance quote and are presented with the products and prices, the:
Prices of products are current at time of display but are subject to change;
Prices are shown in Australian dollars and include GST, other taxes and charges and on-road costs if applicable;
Please note: These interest rates & repayments are an estimate only, and are based on the accuracy of information provided. It does not constitute a quote. Actual loan repayments may vary based on your personal circumstances.
The finance estimations provided to you must be verified directly with the financier by way of a full application to the lender to confirm all appropriate information is accurate and correct.
Please note these terms may change throughout the application process and are to be used as a guide only and is valid to approved applicants only.
Please also note that comparison rates are not available on the products displayed.
We do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of the financial service provider that have provided you with a finance quotation that you have accepted.
Car Request Terms
You may select only one vehicle offer to accept. Upon acceptance of a vehicle offer, you consent to Biddly’s provision of your contact details to the dealer that had provided the offer you had selected.
Upon your acceptance of a vehicle offer, the remaining offers will immediately expire. You will not have rights to reopen remaining offers without our specific approval.
If you select the “I wish to decline all offers” option on the vehicle offers page, you will no longer have rights to receive contact details for dealers providing any of your vehicle offers. You agree to release Biddly from any obligation to provide dealer contact details for these offers once the “I wish to decline all offers” option is selected.
Vehicle offers are valid only until the expiration date specified by the dealer in their vehicle offer. If a dealer is unable or unwilling to honour the vehicle offer prior to the expiration date in the offer, our customer service will work with you to try to create a replacement car request or refund the fees you have paid to us.
We are not liable for damages or losses if a dealer does not honour a vehicle offer after the expiration date specified by the dealer in their vehicle offer.
Purchasing the vehicle from the dealer
We only facilitate requests for price quotations on vehicles from vehicle dealers. Once you select the quote from the dealer and the dealer contacts you, you will be dealing with the dealer under their terms and conditions.
If you purchase the vehicle with the dealer, the purchase will be conducted under the dealer’s terms and conditions and policies and you should read these before proceeding with your booking.
We do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of the dealers that have provided you with a price quotation and vehicle offer that you have accepted.
Delivery of Vehicle Offers
Your BIDDLY offers (for the vehicle specified in your car request) will be accessible via your account within the Biddly website.
We cannot be held liable nor responsible for any loss suffered as a result of a Biddly offers email not being received by you, for example, because the email was blocked by a firewall or filter, or where you told us the wrong email address.
Payments and refunds
All payments must be received in full prior to a car request being forwarded to the Biddly dealership network.
Requests for refunds will be responded to and determined by us at our sole discretion unless:
we have made a mistake;
the service has failed to provide more than one vehicle offer; or
we cannot provide the Services to you.
Limitation of liability
Without affecting any statutory consumer rights that cannot be lawfully excluded or limited:
we will not be liable for any losses, damages, liability, claims or expenses (howsoever caused, including negligence, and whether direct, indirect or consequential) arising from the use of or as a result of any connection with the Website or the Services;
we make no warranty or representation as to the fitness or suitability of any product or service displayed on the Website or any linked site.
Where our liability cannot be excluded, to the extent permitted by law such liability is limited at our option, to resupply of the goods or services supplied or the cost of resupplying the goods or services supplied:
Supply of website services to You / Termination
Biddly reserves the right to change the website & Services at any time. We do not guarantee that you will be able to access the website in the same way or with the same equipment or software you used prior to the change.
We may stop (temporarily or permanently) providing access to the website to you at our discretion and without prior notice to you.
We may in our sole discretion terminate your account or restrict your access to the website. If we do this, you may be prevented from accessing all or parts of the website, your account details or other content contained in your account. We will not be liable to you or any third party for doing so.
The BIddly website may make available access to auxiliary websites supplementary to our main website.
Use of website by you
